结婚，又称婚姻的成立，是指男女双方依照法律规定的条件和程序，确立夫妻关系的民事法律行为。结婚具有以下三个方面的特征：

(1)结婚行为的主体必须是男女双方，同性别的人之间不能结婚；

(2)结婚行为必须依照法律规定的条件和方式进行，即须符合《中华人民共和国婚姻法》所规定的实质要件和形式要件，否则不具有合法婚姻的效力；

(3)结婚行为的法律后果是确立夫妻关系。

法律上对结婚的解释： 中华人民共和国《婚姻法》是规定两性依法结合的法定条件及结合后男女双方的权利义务及由此而产生的其他责任及义务。结婚，法律上称为婚姻成立。它是指男女双方依照法律规定的条件和程序，依法确立夫妻关系，并承担由此而产生的权利、义务及其他责任。婚姻关系的成立有三个基本的法律特征。

一、结婚的主体是男女两性。不是由男女两性生理差别的结合，便不构成结婚。

二、结婚行为是法律行为。申请结婚的双方当事人必须遵守法律的规定，履行法律规定的结婚登记程序，否则，婚姻关系不产生法律后果，即：不受法律保护的无效婚姻。

三、结婚行为的法律后果是，确立双方的夫妻关系，并承担由此而产生的责任、权利、义务。这种已确立的夫妻关系，未经法律程序，任何单位、个人或夫妻双方都无权解除夫妻关系。

(一)结婚的法定条件

1．必须男女双方完全自愿婚姻法第5条规定，结婚必须男女双方完全自愿，不许任何一方对他方加以强迫或者任何第三者加以干涉。这是结婚的首要条件，是婚姻自由原则在结婚制度上的具体体现。这就要求尊重当事人的意志自由，排斥一方当事人、当事人父母或第三人的对他方进行强迫、包办或干涉。当然，法律并不排除当事人的父母或第三人出于关心，对当事人提出意见和建议。但是，是否结婚最终应由当事人自己决定。

2．必须达到法定的结婚年龄法定婚龄是法律规定准予结婚的最低年龄。根据婚姻法第6条规定，结婚年龄，男性不得早于22周岁，女性不得早于20周岁。凡当事人一方或双方未达到法定婚龄的，婚姻登记机关不予登记。但根据婚姻法第50条规定的精神，民族自治地方的人民代表大会基于本民族、宗教、风俗习惯等实际情况，可以对法定婚龄作变通性规定。

3．必须符合一夫一妻制婚姻法第2、3条对一夫一妻制、禁止重婚作了明确规定。婚姻登记管理条例规定:已有配偶的，不予结婚登记；要求结婚的男女，必须双方都无配偶。无配偶包括三种情况:未婚、丧偶和离婚。

(二)结婚的禁止条件

1．禁止一定范围内的血亲结婚婚姻法第7条第1项规定:直系血亲和三代以内的旁系血亲禁止结婚。直系血亲，无论是婚生还是非婚生的，均禁止结婚；三代以内的旁系血亲是指与己身出自同一父母或同一祖父母、外祖父母，除直系血亲外的所有血亲。其范围包括: (1)同源于父母的兄弟姐妹，包括同父母、同父异母或同母异父的兄弟姐妹； (2)同源于祖父母或外祖父母的辈份不同又性别相异的亲属； (3)同源于祖父母、外祖父母的辈份相同的堂兄弟姐妹、姑表兄弟姐妹、舅表和姨表兄弟姐妹。禁止一定范围内的血亲结婚，是基于社会伦理道德、优生优育等因素的考虑。
